Silencers, Supressors & NFA Firearms FAQ

Silencers (also called suppressors or “cans”) are legal for individuals to possess and use for lawful purposes in 39 of the 50 states. In the U.S., the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE or ATF) regulates the manufacture and sale of suppressors under the National Firearms Act (NFA) of 1934.

Frequently Asked Questions

At this writing, Silencers are legal for ownership by private citizens in 39 states, and by licensed dealers and manufacturers in another four states:

Private Ownership Legal: AL, AK, AR, AZ, CO, CT, FL, GA, ID, IN, KS, KY, LA, ME, MD, MI, MO, MS, MT, NE, NV, NH, NM, NC, ND, OH, OK, OR, PA, SC, SD, TN, TX, UT, VA, WA, WV, WI, and WY.

If you are a RESIDENT of one of the states listed above you may purchase a silencer through a licensed dealer in your home state. If you OWN a second home in one of the states listed above, you may be considered a part-time resident of that state while residing in your second home and you may be able to purchase a silencer from a dealer in that state. Contact your local dealer for additional details. We can sell directly to you if you live in Indiana. We can still sell you a silencer if you live in another state, but the sale must go through your local dealer.

If you live in a state that is not listed above, there is no legal way for you to purchase a silencer at all. You can’t go to a legal state to make the purchase. You can’t have a friend, or family member in another state make the purchase for you. YOU must purchase the silencer from a dealer in your state of RESIDENCE.

Yes, if the state you are traveling through is a suppressor legal state. Other ATF regulations require a temporary permit for machine guns or short barrel rifles to travel across state lines. 

It varies based on ATF NFA branch workload, but it can take from 2 weeks to as long as 9-12 months.

As on January 1, 2026 there is no longer a $200 Tax Stamp per silencer! This is the “Transfer Tax.”

Yes. The approved application received from ATF serves as evidence of registration of the NFA firearm. This document must be made available upon request of any ATF officer. It is suggested that a photocopy of the approved application be carried by the possessor when the weapon is being transported.

Buying a Firearm

Three Easy Steps to Purchasing a Firearm:

  1. Find the gun you want: on our website or by calling us at 812-866-5299 and complete your purchase.
  2. Choose a local FFL (Federal Firearms License) dealer to transfer your firearm: All firearms will ship directly to a local FFL dealer of your choice. Any legitimate gun store or gun dealer has an FFL license; pawn shops and collectors may also have them.  Click here to request a transfer.
  3. Receive Your Firearm: Inspect you gun before accepting the transfer pursuant to our Terms of Sale.

Five Easy Steps to Ship and Transfer a Firearm:

  1. Find a licensed FFL dealer in your area.
  2. Contact the dealer to request an inbound firearm transfer from Deputy Big Shot. Be sure to confirm their FFL transfer policies and fees.
  3. Arrange the transfer directly with your local FFL dealer. (We do not arrange the transfer).
  4. Instruct your dealer to provide a copy of their FFL to Deputy Big Shot (click here).
  5. Once you have selected a local FFL for your transfer, please provide us with their name and phone number, either on your order or in a follow up email. Please include your ORDER NUMBER in any correspondence you or your FFL may send us.

We recommend locating a local FFL dealer to transfer your gun before you place your order. However, you can place your order first and then provide us with your FFL dealer info before we ship. We will hold your order for about 7 business days to give you time to locate a dealer and arrange a transfer. If you encounter any problems or special circumstances, please contact us here. We will be happy to address your concerns.

Please take your time to inspect all firearms thoroughly BEFORE proceeding with the transfer. Once a new firearm is transferred to you it is considered used, even if unfired. Consequently, we cannot provide a full refund for new firearms once they have been transferred into your possession. Once you accept the transfer, the gun is considered used and must be returned directly to the manufacturer for warranty repair or replacement.
